Official Rules/Terms of the Stadium Managers Association (SMA) Auction For The 2008 Major League Baseball (MLB) All-Star Game
- Winning bidder (i.e., bidder who submits highest bid) must submit funds within 48 hours of 1 pm EDT on Tuesday July 1, 2008. SMA Staff and their immediate family members are not eligible to bid.
- Bid (US Funds only) for the 2008 MLB All-Star Game Package will ONLY be accepted online via www.stadiummanagers.org by completing the following steps: (1) Visit Foundation page (2) click on the "Place a Bid" link; and (3) Properly follow auction site rules. No other means of bidding will be accepted.
- SMA shall not be responsible/liable for, and bid participants release SMA from, any delays or failure in bid transmissions resulting directly or indirectly from any cause or circumstance beyond SMA's commercially reasonable control, including any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, outages, delays or disruptions.
- The auction will end at 1:00 pm EDT on Tuesday July 1, 2008. Bids received after such time will be rejected.
- Winning Bidder will win the right to use 2008 MLB All-Star Game Package – 2 tickets and round trip airfare (coach) for 2 to New York City.
- Winning Bidder must make arrangements with the SMA office to pay full bid amount in guaranteed US funds on or before 1 pm EDT on July 3, 2008. Upon receipt of payment, the 2 All-Star tickets will be delivered overnight via shipper of bidders choice. SMA will cover the cost of shipping. The winning bidder will need to call the SMA office for airfare arrangements.
- Winning Bidder will be required to complete an affidavit of eligibility and a liability and publicity release, which must be returned to SMA for its receipt prior to July 15, 2008. Such an affidavit will provide in part that (1) the Winning Bidder releases and agrees to hold harmless SMA from any and all liability arising from their participation in the auction and/or their participation or attendance at the 2008 MLB All-Star Game. Winning Bidder agrees to the use of his/her name, address (city, state), photograph, videotape or any likeness of him/her and the 2008 MLB All-Star Game Package for any and all advertising purposes (and any and all rights to said use) without further compensation. Notwithstanding foregoing, Winning Bidder agrees SMA shall not be obligated to advertise or promote Winning Bidder and/or Winning Bidder's company and/or stadium.
- Failure to timely submit the items described in paragraphs 6 and 7 will result in the Winning Bidder's disqualification and the tickets will be offered to the next highest bidder.
- SMA is not responsible for illegible, lost, late, incorrect, incomplete, stolen, misdirected, undelivered or delayed material described in paragraphs 6 and 7, not received by the specified deadlines.
- The Winning Bidders right to the 2008 MLB All-Star Game Package is non-assignable and nontransferable. No substitutions allowed. The right may NOT be transferred, substituted, redeemed, exchanged, or sold for cash and is void if sold, purchased, brokered, or bartered. By participating in this auction, Winning Bidder understands, agrees and acknowledges that a material inducement for SMA to offer the Right, is for the Winning Bidder - not third parties - to use the Right. Winning bidder further understands and agrees that any violation, or threatened violation, of this paragraph 10 will render the tickets void and warrant possible civil and punitive action(s) by the SMA.
- Decisions of SMA with respect to the auction are final. SMA reserves the right to amend, suspend or terminate this auction at any time, which will become effective upon announcement.
- All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant or SMA shall be governed by, and construed in accordance with the laws of the State of Iowa without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the law of any jurisdiction other than Iowa. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the valid or enforceable provision was not contained therein.
- This auction is void where prohibited.
